In one word: Behave!
For those of you who need a little more detail:
- Lawful Use: Geek Niche servers may only be used for lawful purposes. Any site being used to commit a crime, or to otherwise cicumvent the law, will be shut down. The user will be banned from accessing the site, and all corresponding data stored on the Geek Niche servers will either be destoyed or turned over to the proper authorities. In the event that a user is banned for criminal activity, NO REFUNDS WILL BE GIVEN.
- No Spam, No Scam: Geek Niche servers many not be used propogate “spam” (Unsolicited Bulk E-mail) or to promote any pyramid schemes, Nigerian scams, or any other kind of scheme of illegal or dubious nature. In the event that Geek Niche discovers any such activities, ONE WARNING will be given. The user will have a maximum of 24 hours to cease all such activities before they are banned, and all their data destroyed. Geek Niche reserves the right to use their discretion in these matters, and may initiate action in less than 24 hours (including immediately upon discovering the prohibited activity).Geek Niche will allow for the user to appeal their decision, but reserves the right to render all final decisions.
- Content: Geek Niche reserves the right to decide what material is and is not allowed on our servers. If we discover a site which we feel is inappropriate, you will receive a polite request to tone down or modify your content. In such instances, we will work with you to reach a balance which is comfortable for both parties.
- No Hate: Geek Niche will not host sites which promote racism, bigotry, anti-sematism, or violence against any group. Any such sites which are discovered will receive ONE WARNING. The user will have a maximum of 24 hours to cease all such activities before they are banned, and their data removed from the servers. While we strongly believe in freedom of speech, and believe that you have the right to say whatever you want, we also realize that we, as private citizens, are under no obligation to help promote speech or ideas which we find morally objectionable.
- Excessive Loads: Several features of the hosting packages are listed as “unlimited”. This must, however, be balanced against the needs of our other clients. While we aren’t setting specific limits on these features, we do reserve the right to deal with “excessive loads” in those areas. Our first action will be to alert you to the excessive load, and allow you to adjust your usage or upgrade to a more appropriate package. If that doesn’t work, we may assess additional fees, institute individual limits, or, in severe cases, discontinue service. Final decision of what constitutes an “excessive load” rests completely with Geek Niche, and our decisions are final.
- IRC: We do allow IRC servers and bots, but reserve the right to take action if the servers are compromised or used for illegal or “spammy” purposes.
- Refunds: Refunds are handled on a case-by-case basis. In general, we will refund the unused portion of the package price (prorated by day) if less than 10 days has transpired in the billing period. The cost of add-ons and overages is non-refundable. Set-up costs are non-refundable after the first 30 days. Refunds requested on pre-paid accounts will consist of the remainder of the pre-paid funds after the monthly rate has been applied to the account. All refund decisions are final.
- Privacy: Your information is private. Period. We do not–and will not ever–sell, trade, give away, or otherwise share your personal information without your express consent or a valid court order.
- Disconnection: Accounts that are delinquent for 60 days will be deactivated, and will not be reactivated until past due amount is paid in full, and one month paid in advance. Accounts that are delinquent for 90 days will be deleted–including any associated data stored on our servers. Reactivations will be treated as new accounts, and will need a prepay of at least 3 months.
- Collections: Delinquent accounts will be turned over to a collection agency, and may incur an additional penalty (collection fee) of up to 50% of the past-due amount.
